CustomPix – Terms of Service

These Terms of Service ("Terms") govern your use of the CustomPix Shopify app ("App", "Service") provided by Claymind LLC ("we", "us", "our"). By installing the App from the Shopify App Store or using the Service, you ("Merchant") agree to be bound by these Terms and Shopify's Partner Program Agreement and Acceptable Use Policy.
1. Description of Service
CustomPix is a Shopify app that enables merchants to offer product personalisation on their storefront. Customers can upload images that are composited onto product mockups and submitted as part of an order. The App operates as an embedded experience within the Shopify admin using Shopify App Bridge.
2. Shopify App Store Compliance
By installing and using CustomPix, you acknowledge that:
Embedded Experience: The App is designed to operate within the Shopify admin via Shopify App Bridge. Your use of the App requires an active Shopify store.
Authentication: The App uses standard Shopify OAuth for authentication. You must not attempt to bypass or circumvent this authentication flow.
Billing: All subscription or usage charges for CustomPix are processed exclusively through Shopify's Billing API. No off-platform payments are collected or required. Pricing and billing terms are disclosed clearly in the App listing.
Partner Program Agreement: We operate in full compliance with Shopify's Partner Program Agreement and Acceptable Use Policy. Violations of those policies may result in removal of the App from the Shopify App Store.
Functional Parity: The App functions as described in its Shopify App Store listing. If you experience functionality that materially differs from the listing, please contact us.
3. Merchant Responsibilities
You are responsible for ensuring your storefront complies with all applicable laws, including data protection regulations (e.g. GDPR, CCPA) where relevant to your customers.
You must clearly inform your customers that their uploaded images will be stored and processed as part of their order.
You must not use the App to collect, store, or process sensitive personal data beyond what is necessary for order fulfilment.
You are responsible for obtaining any necessary consents from your customers regarding the collection and use of their images and order data.
You must not use the App for any purpose that violates Shopify's Acceptable Use Policy.
4. Data Processing & GDPR
Data we collect and store on your behalf:
Customer-uploaded images (stored in a private Google Cloud Storage bucket; never on Shopify's CDN)
Cart token and order ID (used to associate images with orders)
Your Shopify shop domain
How we use this data:
Solely to link uploaded images to the correct orders for fulfilment purposes.
We do not sell, share, or use customer data for marketing or any other purpose.
GDPR Mandatory Webhooks: We implement all three Shopify-required GDPR webhooks:
Customer data request (customers/data_request): Upon receiving a data request, we will provide a summary of all data held for that customer within 30 days.
Customer data redact (customers/redact): Upon receiving a redact request, we will delete all personal data associated with that customer within 30 days.
Shop data redact (shop/redact): Upon uninstallation, we will delete all data associated with your shop within 30 days.
Retention:
Uploaded images and associated records are retained while your store is active and using the App.
Upon uninstallation, all shop data is deleted within 30 days in accordance with the shop redact webhook.
Security:
All data is encrypted in transit (TLS/SSL) and at rest (Google Cloud Storage default encryption).
Image URLs are served via time-limited V4 signed URLs and are never publicly accessible.
We maintain valid TLS/SSL certificates at all times as required by Shopify's technical requirements.
5. Performance
We endeavour to maintain fast response times across all API endpoints (targeting sub-200ms for 95% of requests) and to ensure the App does not degrade your merchant store's performance. We monitor the App continuously and address performance issues as a priority.
6. Intellectual Property
You retain all rights to the images your customers upload through your storefront.
We claim no ownership over customer-uploaded content.
You grant us a limited, non-exclusive licence to store and process uploaded images solely for the purpose of providing the Service.
7. Prohibited Use
You must not use the App to process or store:
Illegal content, including images that infringe third-party intellectual property rights.
Content that is obscene, defamatory, or harmful.
Any data unrelated to the customisation and fulfilment of orders.
Any content prohibited under Shopify's Acceptable Use Policy.
8. Availability and Support
We will make reasonable efforts to keep the Service available, but do not guarantee uninterrupted or error-free operation.
We reserve the right to modify or discontinue the Service at any time with reasonable notice.

9. Limitation of Liability
To the maximum extent permitted by law, Claymind LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the App, including but not limited to loss of revenue, loss of data, or business interruption.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the App after changes are posted constitutes acceptance of the updated Terms. We will notify merchants of material changes via the Shopify Partner Dashboard or email.
11. Governing Law
These Terms are governed by the laws of California. Any disputes shall be resolved in the courts of that jurisdiction.
